Indian Muslim ' Response to Demolition of Babri Masjid exemplary; Mufti

GNS SRINAGAR DEC : Calling for a "focused" follow-up of the Sachar Committee report on minorities, patron of Jammu and Kashmir's main opposition Peoples Democratic Party Mufti Mohammed Sayed today said the "unfortunate demolition of Babri Masjid had caused a deep wound into the psyche of the Muslims of India but they have responded to it with exemplary aplomb and sense of responsibility".  In a statement issued on the anniversary of the Babri Masjid demolition, the PDP patron said pulling down of the holy site was a great challenge to the spirit of India as much as it was for the communities in an atmosphere surcharged with emotion and rhetoric.  He said decades down the line it has been established that the rights of the minority community cannot be compromised or denied. He said the people of the country had through successive elections conveyed a clear message to communal forces to either fall in line with the secular constitution or remain out of the polit...

GNS SRINAGAR:  Maharaj Gunj, which has a history of more than 200 years and once used to be the nerve centre of the commercial activities, has lost its sheen owing to the negligence by the successive state governments. This market is believed to have been constructed by the Maharaja Ranbhir Singh in 1806, in an era when merchandise was transported on bullock carts to many Mandis (wholesale markets) of South Asia through the Jhelum Valley road (now called Srinagar-Muzaffarabad road). The market falls in the congested area of the Downtown area of Srinagar city on the banks of River Jhelum and houses more than 2000 shops. In Pakistan-controlled Kashmir, residents see experiment with autonomy as 'illusion'

One area of Pakistan-controlled Kashmir was given limited autonomy in 2009 and hailed as a successful model for the disputed region – but many residents say there hasn't been enough change. Baba Jan, a 30-something political activist from Gilgit Baltistan in northeast Kashmir, was jailed by Pakistani police in mid-September for inciting unrest, considered terrorism. From jail, where he was imprisoned along with about 50 other political workers, Mr. Jan claims the real reason for his detention and indefinite extension has to do with his politics: Jan’s Labor Party actively demands greater autonomy and a referendum on independence for Gilgit-Baltistan, which lies in disputed Kashmir. Pakistan doesn’t want that. “We want our assembly to decide whether to join China, Pakistan, or India – but I’d prefer independence,” says Jan.  “Why join a country that uses terrorism in the name of Islam? No human rights, no political rights and no free judges. No one wants t...

FSPA And New Legal Perspective in CRPC

By: Dr.Javid Iqbal AFSPA as per the latest reports is sought to be replaced by two clauses of ‘Criminal Procedure Code’ [CrPC] section 45 and Section 197-A. While section 45 deals with protection of members of the Armed Forces from arrest, section 197-A deals with prosecution of civil servants. As per section 45 “No member of the Armed Forces of the Union shall be arrested for anything done or purported to be done by him in the discharge of his official duties except after obtaining the consent of the Central Government.” Section 197-A relates that no courts will take cognizance of an offence committed by a public servant “while acting or purporting to act in the discharge of his official duty” until a sanction was accorded by the Central Government. The question remains that is either legal enough to be called law or old wine in new bottles! On the face of it each appears to be a replica of the other, in that both imply sanction of central government to proc...

By  Inam Un Nabi GNS SRINAGAR ; The Association of Parents of Disappeared Persons (APDP) has demanded an impartial forensic probe into all unmarked graves across the Valley to see if there is a link between Kashmir’s disappeared people and bodies found in such graves. This follows the ‘official’ discovery of 2,156 bodies in unmarked graves in North Kashmir by the J&K Human Rights Commission (SHRC). Activists, who feel this is just the tip of the iceberg, have asked the SHRC to document similar atrocities in the rest of Kashmir too. Last month, the ADPD issued a statement, “Out of 53 cases we submitted to the SHRC, it has been established that 49 were local civilians. The exhumations at Panchalatan, Ganderbal, Kichama, Macchil have confirmed forensically that forces have been responsible for killing civilians in fake encounters.” SHRC secretary Tariq Banday hesitates to link Kashmir’s disappeared to bodies found in these graves. “This is presumptuous.” H...
