FSPA And New Legal Perspective in CRPC

By: Dr.Javid Iqbal AFSPA as per the latest reports is sought to be replaced by two clauses of ‘Criminal Procedure Code’ [CrPC] section 45 and Section 197-A. While section 45 deals with protection of members of the Armed Forces from arrest, section 197-A deals with prosecution of civil servants. As per section 45 “No member of the Armed Forces of the Union shall be arrested for anything done or purported to be done by him in the discharge of his official duties except after obtaining the consent of the Central Government.” Section 197-A relates that no courts will take cognizance of an offence committed by a public servant “while acting or purporting to act in the discharge of his official duty” until a sanction was accorded by the Central Government. Farooq And Omer Condoles Demise Of Lone    GNS JAMMU, :  The Union Minister for New and Renewable Energy and President National Confe rence, Dr. Farooq Abdullah has expressed sorrow over the sad demise of former MLC and political personality of Rajouri Bashir Ahmad Lone. Pahari Hostel Rajouri ,A Hub Of Corruption

GNS Rajouri,   ;The district administration has ordered a probe into the large scale corruption and misuse of funds by the officials in Pahari hostel in this border district of Jammu and Kashmir. Sources told GNS on Tuesday that acting on complaints of corruption and other malpractices in Pahari students' hostel, Deputy Commissioner Rajouri, Ghulam Ahmed Khawaja has ordered a detailed probe of the matter. Farooq Ahmed Shah, Assistant Commissioner Defence, has been appointed as inquiry officer, said sources adding that inquiry officer has initiated probe with immediate effect. Sources said, complaints of corruption and other malpractices were leveled by students and some members of Pahari Advisory board including Bashir Ahmed Wani who is also district president of ruling National Conference in Rajouri.
